Terms of Use
These Terms explain the rules for using Connect, including digital profiles, NFC cards and accessories, subscription features, bookings and profile-owner payment tools.
1. Agreement and operator
Connect is a digital professional-identity product operated by Chibara. These Terms form an agreement between Chibara and the person or organisation that creates an account, buys a Connect product, uses a Connect-managed service, or otherwise uses the platform.
By creating an account or using Connect, you agree to these Terms and the policies that apply to the feature or transaction you use. If you act for an organisation, you confirm that you are authorised to bind that organisation. If you do not agree, do not use the service.
Some transactions also involve a separate profile owner, merchant, booking provider, courier, payment provider or authentication provider. Their own terms may apply to their part of the service. Connect does not replace those agreements.
2. Accounts and access
You must provide accurate account information, keep it current, and protect your password and any connected sign-in method. You are responsible for activity performed through your account unless you promptly report unauthorised access and the law provides otherwise.
Do not share credentials, bypass access controls, impersonate another person, or create an account using information you are not entitled to use. Tell us promptly if you believe an account, profile, NFC card, QR code or secure link has been compromised.
Organisation administrators may manage organisation-owned fields, profiles, subscriptions and card assignments where the product allows it. Administrators do not receive a member’s password. The organisation is responsible for appointing appropriate administrators and removing access when roles change.
3. Profiles, links, QR codes and NFC products
Connect lets account holders create and publish professional profiles. You retain responsibility for the names, contact details, images, links, documents and other material you add. You must have the rights and permissions needed to publish that material and to share personal information about other people.
A Connect NFC product stores or resolves to a stable Connect address; it does not permanently store every field of a live profile. The destination may change when an authorised user reassigns or updates the card. A person who possesses an active card, QR code or accessible profile link may be able to open the destination, subject to the profile’s visibility settings.
Lost, transferred or misused cards should be reported and disabled or reassigned promptly. Connect cannot guarantee that a previously shared link, downloaded contact file, screenshot or copy will be deleted from a recipient’s device.
4. Plans, subscriptions and entitlements
Free and paid plans may provide different limits and features. Plan descriptions shown at checkout or in the pricing page form part of the transaction. Paid access normally applies to the selected profile, not automatically to every profile in an account.
Subscription charges are collected in advance for the billing interval displayed at checkout and may renew automatically until cancelled. Prices are displayed in the stated currency and include or exclude taxes only as shown at checkout. We verify the selected plan, amount and payment result on the server before activating paid access.
A failed or reversed payment may place the subscription into a past-due state. If a grace period is offered, access may continue only until that period ends. Cancellation, renewal, refunds and plan changes are described in the Cancellation Policy and Refunds & Returns Policy.
5. Physical product orders
An order is accepted only after Connect confirms it. Product appearance, customisation, quantity, price, delivery charge and estimated timing are those presented or agreed for that order. We may contact you to resolve unavailable stock, custom artwork, address problems or other fulfilment issues before production or dispatch.
Customised products may enter production soon after payment and may not be eligible for change-of-mind cancellation where applicable law permits. Defective, damaged or incorrectly supplied goods remain subject to the Refunds & Returns Policy and your non-excludable consumer rights.
Shipping estimates are not guarantees. Risk, attempted delivery, address corrections and collection arrangements are addressed in the Shipping & Delivery Policy.
6. Bookings and profile-owner payments
Connect may allow a profile owner to publish services, accept bookings, and connect their own supported payment account. In those transactions, the profile owner—not Chibara—is the service provider or payee. Connect supplies the technology that displays availability, records booking details and initiates hosted payment checkout.
Service descriptions, prices, availability, delivery of the booked service, cancellations, rescheduling and service-specific refunds are the profile owner’s responsibility unless Chibara expressly identifies itself as the provider. Payment funds settle according to the connected provider account and provider rules. The Booking & Payment Terms explain this boundary in more detail.
7. Acceptable use and enforcement
You must comply with the Acceptable Use Policy. We may remove content, restrict a feature, disable a card, suspend a profile or account, or preserve evidence where reasonably necessary to protect users, investigate suspected misuse, comply with law, respond to a valid request, prevent security harm, or enforce these Terms.
Where reasonably practicable, we will consider the seriousness and urgency of the issue and may give notice or an opportunity to remedy it. Immediate action may be necessary for fraud, security incidents, unlawful content, threats, abuse or material harm.
8. Intellectual property
You retain ownership of content you submit. You grant Chibara a limited, non-exclusive licence to host, reproduce, resize, transmit and display that content only as needed to operate, secure, support and improve the Connect service you requested. The licence ends when the content is deleted from active systems, subject to reasonable backups, legal retention and copies made by recipients.
Connect’s software, branding, layouts, documentation and original materials remain owned by Chibara or its licensors. These Terms do not transfer those rights. You may not copy, reverse engineer, resell or exploit the service except where the law permits or Chibara agrees in writing.
9. Availability and changes
We aim to keep Connect reliable, but online services, payment providers, email, couriers, browsers, devices and NFC hardware may fail or be interrupted. We do not promise uninterrupted or error-free availability. Planned maintenance and urgent security work may temporarily affect access.
We may improve, replace or retire features. If a material change significantly reduces an active paid feature, we will take reasonable steps to notify affected customers and provide an appropriate remedy where required by law or the applicable transaction terms.
10. Responsibility and liability
Each party remains responsible for loss caused by its unlawful conduct or breach, subject to applicable law. To the extent the law permits, Chibara is not responsible for indirect or consequential loss, information a user chose to publish, a profile owner’s services, a third-party provider’s acts, or circumstances reasonably outside Chibara’s control.
Nothing in these Terms excludes or limits liability, warranties, remedies or consumer rights that cannot lawfully be excluded or limited under South African law, including rights that may apply under the Consumer Protection Act, 2008.
11. Changes, notices and applicable law
We may update these Terms to reflect product, provider, legal or security changes. The current version and effective date will appear on this page. For material changes, we will use a reasonable notice method, such as an in-product message or account email, before the change takes effect where practicable.
These Terms are governed by the laws of the Republic of South Africa. This does not remove any mandatory right or forum available to a consumer under applicable law. Contact us first so we can try to resolve a concern through the Complaints Procedure.
